WASHINGTON: President Donald Trump on Monday (Jul 9) announced Brett Kavanaugh as his nominee for the US Supreme Court, picking a conservative federal appeals court judge who survived a previous tough Senate confirmation battle and helped investigate Democratic former President Bill Clinton in the 1990s. Trump, with the unique opportunity to make two lifetime appointments to the nation's highest judicial body in his first 18 months as president, selected Kavanaugh, 53, to replace long-serving conservative Justice Anthony Kennedy, who announced his retirement on June 27 at age 81. Kavanaugh was picked by former president George Bush to serve on the influential Washington-based appeals court in 2003. Contentious confirmation hearings in the Senate delayed his confirmation until 2006. Prior to his appointment, Kavanaugh worked as a lawyer in the White House under Bush. Some conservatives activists have criticised Kavanaugh for his ties to the Bush family and some of his rulings, … [Read more...] about Trump picks conservative Kavanaugh as US Supreme Court nominee

Plea in Supreme Court seeks appointment of regular CBI Director through high-power panel
A writ petition has been filed in the Supreme Court seeking the appointment of a regular CBI Director through the high-power selection committee of the Prime Minister, the Chief Justice of India and the Leader of the Opposition. “The government has failed to appoint the Director of the CBI as per Section 4A of the Delhi Special Police Establishment Act of 1946 on the expiry of the term of the last incumbent, Rishi Kumar Shukla, on February 2, 2021,” NGO Common Cause, represented by advocate Prashant Bhushan, said. The petition pointed out that instead of a regular appointment to the top CBI post, the government appointed Praveen Sinha on February 3 as an “interim/acting CBI Director.” The petition said such an interim appointment through an executive order was not envisaged in the statutory scheme of the 1946 Act. The CBI Director is a sensitive post. The Director is the final authority in the organisation in several sensitive investigations. Supreme Court Justice Richard Gabriel faced harassment accusation while a candidate for Colorado’s high court
A harassment accusation made nearly eight years ago against Colorado Supreme Court Justice Richard Gabriel, then a judge on the state Court of Appeals, by a newly hired law clerk was settled quickly and quietly, according to two people with knowledge of the agreement, essentially ensuring it would not sully his shot at the high court. To safeguard that secrecy, the Colorado Judicial Department had the female appellate law clerk who made the accusation in September 2013 – then a 34-year-old who was a year out of an Ivy League law school – sign a non-disclosure agreement that kept her on the payroll for a year in return for her promise not to sue, the sources confirmed for The Denver Post. The woman claimed the judge and a male law clerk in the court created an uncomfortable work environment for her shortly after her arrival in August 2013, the sources said. In an email to The Post, Gabriel said that “any suggestion that I engaged in any form of harassment of anyone at any time is … [Read more...] about Supreme Court Justice Richard Gabriel faced harassment accusation while a candidate for Colorado’s high court
Supreme Court defers hearing of challenge to T.N.’s 69% quota
The Supreme Court on Wednesday deferred hearing a challenge to the Tamil Nadu reservation law , which allows 69% quota in State government jobs and educational institutions. A Bench of Justices Ashok Bhushan and R. Subhash Reddy decided to wait till a Constitution Bench pronounces its judgment in the Maratha quota case . The five-judge Constitution Bench, also led by Justice Bhushan, is scheduled from March 8 to examine the validity of the Maharashtra State Reservation for Socially and Educationally Backward Classes (SEBC) Act of 2018. By including the Maratha community for quota benefits, the Maharashtra law, like Tamil Nadu’s legislation, has crossed the 50% ceiling limit and touched 65%. The Constitution Bench has fixed a deadline of March 18 to complete the hearing in the Maratha case. The deferment draws the spotlight away from the reservation law ahead of the Assembly election in Tamil Nadu. During the hearing on Wednesday, senior advocate Mukul Rohatgi, for the … [Read more...] about Supreme Court defers hearing of challenge to T.N.’s 69% quota
